Thus, these terms and conditions regulate the conditions applicable to navigation by users within the Website.

TEP makes this Website available to users in order to provide useful information about the activities and services offered by the company and allow the purchase of the programs offered at any time through the Website (hereinafter, the " Program(s) ”).

A user (hereinafter, the “ User ” or the “ Users ”) is defined as the person who interacts within the Website as (i) a student who has purchased any of the Programs, (ii) a registered user, but who has not purchased any Program, or (iii) user browsing within the Website. The first two Users mentioned (i) and (ii) will also be identified in these terms and conditions with the name of registered user (hereinafter, the " Registered User(s) ").

Being a User implies the acceptance of these terms and conditions (hereinafter, the “ Terms and Conditions ”) that expressly regulate the contractual relations arising between TEP and third parties that contract products or services offered on the Website. In this sense, TEP informs Users of the following:

 

  • TEP will record by technical means the day and time on which the User accepted these Terms and Conditions, together with their IP address and other related information. TEP will not file a specific contract with the User, the registration described above being sufficient proof of the User's acceptance of these Terms and Conditions.
  • The User can correct any information provided erroneously through their user profile or by sending an email to hola@emergprogram.com.
  • The User may only have these Terms and Conditions in Spanish and English.

 

  1. Object and scope of application

Next, we will describe the conditions that regulate the acquisition of the Programs through the Website and the rights and obligations derived from the subscription of these services.

The acquisition of the Programs must be carried out according to the instructions mentioned in these Terms and Conditions, as well as any other specific conditions that are indicated on the screen during navigation or in any other way, so that the Registered User declares to know and accept said procedures as necessary to access the services and/or Programs offered on the Website.

 

  1. Procedures for the acquisition of the Programs

The Programs are a series of online training programs created by TEP that consist of theory, analysis, interviews and value-added documents on emergencies, forest fires, etc. In addition, the Programs include other types of benefits, such as webinars; virtual and face-to-face events; participation in targeted forums; resolution of doubts in real time and/or others that TEP could determine at all times.

In this sense, TEP informs the User that EMERGPROGRAM, SL is a private company, not linked to any public or private university or educational entity, and that the certificates it issues are strictly private, although they may benefit from certain incentives, such as those relating to to certain subsidized training in Spain. This implies that the Programs do not have, among others, AACSB, AMBA, EQUIS or other similar certificates.

Therefore, the certificate that TEP issues at the end of the different Programs is of a private nature and is not issued or recognized by any public or private entity other than TEP itself, so obtaining the aforementioned certificate does not imply recognition or positive evaluation of the Program carried out by the User by any third party, including TEP collaborators who may have participated in the realization of the Programs.

Mandatory, Users who wish to purchase the TEP Programs must be of legal age or, if they are not, have the express authorization of their legal representatives to make the purchase and participate in the Programs. At the time of making the purchase, the User expressly declares and guarantees that they have full legal capacity to contract the services provided by TEP or, if they need any type of authorization from a third party, that they have it and can prove it.

To acquire the Programs offered through the Website, the User must, beforehand, carefully read these Terms and Conditions.

The Programs offered on the Website, along with their characteristics and price, will appear on the explanatory screens for each of them. The price indicated on the screen will be shown in Euros, in Dollars or in the local currency of each country and will include the applicable indirect taxes, unless otherwise stated. This price will be the one in force at all times when the User makes the purchase, except for a typographical error. TEP regularly carries out promotional campaigns that may include discounts on the price of the Programs, for example, through coupons or discounts. At the time of payment, coupon codes, discounts or any other method established by TEP may be entered, which reduce the price of the order by the amount previously established.

To purchase the Programs on the Website, the User must select the desired Program and press the "Buy" or "Sign up for the Program" button or similar expression and proceed to complete the required information, after which they must make the payment. . To do this, you must previously check the characteristics exposed on the Website about the specific Program, with the options that the User has chosen for payment in installments or not, limited access for the indicated time or unlimited in time, price, or applicable taxes. if any, to assess whether it suits your needs.

In the event that the user chooses to finance the payment with a financial entity without TEP being part of said operation, the User is fully aware and accepts that he freely signs said contract with the third party entity and that TEP will at no time be responsible for any issue arising from such financing.

Subsequently, TEP will request that the User enter certain data on the Website, by completing an electronic form, being necessary for the latter to provide all the data that is marked as mandatory by means of an asterisk (*). The  Privacy Policy  adopted by TEP determines how the personal data of Website Users will be processed.

The User will receive on screen the conditions of the acquisition and must accept them to continue with their purchase. The fact that the User accepts these conditions does not imply the automatic acceptance and formalization of the purchase, TEP must send a confirmation message to the email provided by the User in the registration form. However, the purchase will not be considered formalized, in any case, if the full payment of the price of the Program by the User has not been made.

Payment of the price of the Program acquired on the Website will be made by payment by credit or debit card, or in accordance with any other means of payment that are enabled on the Website at any time.

To proceed with the payment, the amount and the purchase reference will appear on the screen and the User will be asked to provide the information that appears on the screen, which in any case will include the following: a) Card number; b) Expiration date; c) CVV (three-digit security code printed on the card). TEP may use third-party payment platforms and/or tools to manage payments that facilitate the payment of the consideration for the contracted Programs. In particular, in order to guarantee the greatest security to the User, TEP informs you that, as an electronic payment system, it has a collaboration agreement with the online secure payment platform Stripe, although it could change for operational or similar reasons. .

In the case of opting for the "payment in installments" modality and the Registered User does not attend the agreed regular payments, TEP will proceed to notify the user of said lack of payment, granting him a term for its correction and if this does not occur, TEP will proceed to the suspension of access to the Program until such payment is made. TEP reserves the right to claim the amounts due if it is verified that the degree of use of the Program materials exceeds the proportion of the amounts paid compared to the total price agreed.

 

  1. Characteristics, guarantee and withdrawal
  • Characteristic

The Website is an online training platform, aimed at people interested in the business world that offers a complete training program in this area from an eminently practical perspective.

The TEP Programs consist of a training program, in digital format (video, audio, downloadable resources, or other benefits, such as webinars; virtual and face-to-face events, participation in forums, etc.) that the User can enjoy and have access to, prior payment of the indicated amounts. The User will have access to the private area of ​​the Program, with the available materials, during the period described below for each of them:

  • The User will have access to the private area of the Programme, including the contents which will be available for the period of time specified below:
    * 6 months for all courses except TEP Advance.
    * 12 months for the TEP Advance course.
  • Warranty

 

TEP will provide the services with the maximum possible efficiency, given the currently existing means and technologies. However, the User must be aware that TEP cannot fully guarantee the reliability, continuity, usefulness, absence of faults and/or harmful software, or veracity of absolutely all the information and/or services on the Website, nor of the usefulness or veracity of the contents made available through it.

TEP will periodically review the content and information made available to Users on the Website, but cannot fully guarantee its accuracy and updating at all times. In the event that the User who has purchased a Program detects, during the period of access to it, or in the 24 months after the opening of the Program, any defect such as lack of documentation, content or agenda with respect to what was previously announced by TEP , you can get in touch with it, indicating the defects and sending graphic documents where they can be seen. TEP will inform the User of the way to proceed in order to solve the problems after evaluating the circumstances of the specific case.

Consequently, TEP does not guarantee nor is it responsible for: (i) the continuity of the contents of the Website; (ii) the absence of harmful components on the Website or on the server that provides it; (iii) the invulnerability of the Website and/or the impregnability of the security measures adopted; (iv) the damages caused, to himself or to a third party, by any person who violates the conditions, rules and instructions that TEP establishes on the Website or through the violation of the security systems of the Website.

Notwithstanding the foregoing, TEP declares that it has adopted all the necessary measures, within its possibilities and the state of the art, to guarantee the operation of the Website and avoid the existence and transmission of harmful components.

TEP will not be responsible for the veracity, completeness or updating of the information published on the Website from sources unrelated to it (external news, user opinions, consideration of the Programs by third parties or entities, etc.).

TEP will not assume responsibility for hypothetical damages that may arise from the use of the aforementioned information. In no case, the mentioned contents, opinions, comments and/or links will be considered as a recommendation, sponsorship, promotion or publicity by TEP.

TEP will not be liable for causes beyond its control, among which may be listed in a non-limiting manner: force majeure, Internet access problems, technological problems beyond the diligent and reasonable management of the owner of the Website, actions or omissions of third parties. , any fact related to the hiring or not of the Users of the Website, etc. In all the aforementioned cases, beyond the control and due diligence of TEP, there will be no compensation from TEP to the User for damages or losses, to the extent permitted by current legislation.

  • Right of withdrawal

TEP informs the User that they may withdraw from the purchase of any Program, for a period of 15 days from the moment in which the contracted Program is opened to the User.   1. TEP Obligations

TEP undertakes to comply with the following obligations:

  • Make available to the User on the Website the necessary information regarding the Programs to be acquired.
  • Send the User to the email address that he/she indicates in the registration form, a verification that shows the reception by TEP of the request to start the Program, as well as the terms and conditions of the same.
  • Once the purchase has been made, TEP undertakes to make the Program material or the access codes available to the User at the email address provided.
  • Likewise, during the duration of the Program, TEP will give the User access to other services, such as webinars; virtual and face-to-face events; participation in targeted forums; resolution of doubts in real time and/or others that TEP could determine at all times.
  • All shipments of keys or material on the Programs are subject to confirmation of the payment operation and technical availability.
  • Use all the care and professionalism that are considered reasonable for the provision of the services and the Programs that it offers.

 

  1. Responsibilities

The User will be responsible for:

  • All those acts that contravene the provisions of these Terms and Conditions, the law, morality, generally accepted customs and public order.
  • Any act carried out in a manner different from what TEP designates in its indications or instructions regarding the use of the Website and the purchase of the Program.
  • The certainty, accuracy, validity and timeliness of the data with which you will fill in each of the forms that TEP exposes on the Website.
  • The direct or indirect damages that have been caused by any third party if the User lost, revealed, neglected or, in any way, let a third party know their personal data, necessary for registration on the TEP Website or the purchase of a Program.
  • Use the Website in a way that could cause damage, interruptions, inefficiencies or defects in its operation.
  • The correct custody of your passwords and credentials, which you may not share with any other person at any time.
  • Use the Website for the transmission, installation or publication of any virus, malicious code or other harmful programs or files.
  • Use the Website to collect personal data from other users.

  • The hiring and candidacy processes that the User can enjoy, without the realization of the Programs implying any guarantee regarding the hiring of the User.

 

In all the aforementioned cases, beyond the control and due diligence of TEP, there will be no compensation from TEP to the User for damages, to the extent permitted by current legislation. On the contrary, the User will be liable for damages of any nature that TEP may suffer as a result of breach of any of the obligations to which the User is subject.

For its part, TEP will not be liable for damages that the misuse of the Website and its content could cause the User or a third party, for reasons not attributable to TEP. In any case, the liability that may be required of TEP by the User shall be limited to the price of the Program purchased by the User. In particular, TEP expressly excludes the following guarantees and responsibilities from the provision of its services:

  • TEP reserves the right to remove any content that may damage its image, may cause commercial damage and may threaten the dignity of community members or other affected persons.
  • TEP reserves the right to interrupt access to the Website, as well as the provision of any or all of the services provided through it, at any time and without prior notice, whether for technical reasons, security, control, maintenance or for any other well-founded cause. If the user becomes aware of the existence of any content that is illicit, illegal, contrary to the law, security breach or that could imply an infringement of intellectual and/or industrial property rights, they must immediately notify TEP through the email address email hola@TEP.com so that you can proceed to adopt the appropriate measures. TEP will verify this report, as soon as possible, and will adopt the measures it deems appropriate.

Similarly, in the event that any User or a third party considers that any of the contents of the Website violates their intellectual and/or industrial property rights, as well as any other rights, they must send a communication to hola@TEP.com with the following information:

The acceptance of the purchase of the Programs by the Users will be governed by the Terms and Conditions published at that time on the Website.

THE PROGRAMS ARE NOT RECOGNIZED BY ANY INSTITUTION OR ENTITY. TEP DOES NOT GUARANTEE THAT THE PERFORMANCE OF THE SAME WILL INCREASE THE POSSIBILITIES OF HIRING THE USER, INCREASES IN SALARY OR OTHER PROFESSIONAL IMPROVEMENTS, NOR THAT THE PERFORMANCE OF THE PROGRAMS OR THE PROVISION OF THEIR CONTENT WILL BE DONE UNINTERRUPTED AND INDEFINITE IN TIME OR THAT PARTICIPATION IN THE PROGRAMS DOES NOT IMPAIR THE USER OF ANY KIND OF DISCREDITION. EXCEPT AS PROVIDED HEREIN AND TO THE EXTENT PERMITTED BY LAW, ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF THE PROGRAMS, QUALITY AND FITNESS FOR A PARTICULAR PURPOSE OF THE USER, ARE EXCLUDED BY TEP. The contracting of any service and/or Program through the Website will be governed by Spanish legislation, which will be applied in what is not provided in these Terms and Conditions in terms of interpretation, validity and execution.

In the event of any type of discrepancy or claim between the parties, in relation to the fulfillment or content of these Terms and Conditions, the parties will negotiate in good faith to try to resolve such discrepancy or claim within a maximum period of one month, counted from the date on which either of them formally notifies the other of the discrepancy that has arisen, or notifies the claim.

However, in the event that the discrepancy or claim is not resolved within the maximum period indicated and only in cases in which the regulations provide for the possibility of the parties submitting to a jurisdiction, TEP and the User, expressly waiving to any jurisdiction that may correspond to them, submit the decision of the matter raised to the Courts and Tribunals of the city of Madrid (Spain).
